NCIA General Bidding Instructions

These General Bidding Instructions apply to all NCIA competitive procurements using the NATO Competitive Procurement (NCP) method and are supplemented by project-specific bidding instructions provided to potential bidders during the solicitation phase of each opportunity.

NCIA Project-Specific Book I-Bidding Instructions

Each procurement conducted under the NCP procedure is accompanied by bidding instructions, requirements, and details tailored to that specific procurement, hereinafter referred to as the 'Project-Specific Book I'.

The General Bidding Instructions and the Project-Specific Book I (for both the Best Value (BV) and Lowest Price Technically Compliant (LPTC) source selection methodologies) shall be read together as a single, complete set of documents. In the event of any discrepancy between the two, the Project-Specific Book I shall prevail, ensuring that Bidders comply with the particular requirements of each individual procurement.

This Project-Specific Book I is provided for informational purposes only and does not represent the full set of project-specific terms. The Project-Specific Book I applicable to any given procurement will be issued as part of the relevant solicitation.

NCIA Contract and Purchase Order Terms and Conditions

NCIA Contract General Terms and Conditions

The NCIA Contract General Terms and Conditions (GTC) provide a standard set of clauses that apply to all contracts issued by the NCIA. They establish the baseline contractual provisions, including governing law, payment and delivery terms, security requirements, and warranty. The GTCs consist of a core set of provisions applicable to all contracts, complemented by six tailored subsets for specific requirement types: Services; Equipment; Commercial Off-The-Shelf (COTS) Software or Licenses; Software Developed for NATO Purposes; Cloud Services; and Artificial Intelligence (AI) Systems or AI-Enabled Services. GTCs are not modified directly. Any necessary tailoring is implemented through Special Terms and Conditions (STCs).

NCIA Contract Special Terms and Conditions

The NCIA Contract Special Terms and Conditions (STC) are contract-specific provisions used to tailor the General Terms and Conditions (GTC). They are used to:

  1. Supplement the GTC through additional provisions;
  2. Modify specific GTC provisions; or
  3. Replace specific GTC provisions in their entirety

The STCs provided here are for informational purposes and are not exhaustive. The applicable STCs for any given procurement will be specified in the relevant solicitation.

NCIA Standalone Purchase Order Terms and Conditions

The Terms and Conditions for Standalone Purchase Orders (POs) are for those procurements not accompanied by either a Contract General or Special Terms and Conditions (GTCs or STCs). Generally, procurements below or equal to Established Financial Limit (EFL) Level E (currently ≤1.6M€) adhere to Standalone Purchase Order Terms and Conditions, whereas procurements above EFL Level E adhere to GTCs and STCs.

NCIA Competitive Procurement Dispute Resolution Procedures

The NCIA Competitive Procurement Dispute Resolution procedure outlines the process of resolving disputes related to the NCIA competitive procurement process. Matters arising after contract award, including disputes related to contract administration or performance, fall outside the scope of this procedure.

NCIA and NATO Directives or Policies

NCIA Supplier Code of Business Ethics and Conduct

The NCIA Supplier Code of Business Ethics and Conduct sets out the standards expected of all suppliers, contractors, and subcontractors doing business with the NCIA. It reflects the principles of good governance and transparency established in the NATO Procurement Policy (NPP) and the NCIA Code of Ethics. Suppliers are expected to conduct business with honesty, fairness, and integrity, and to comply with all applicable laws, regulations, and contractual obligations. Adherence to the Supplier Code of Business Ethics and Conduct is a requirement for doing business with the NCIA and is embedded in the NCIA Contract General Terms and Conditions.

NATO Supply Chain Security Requirements

This document specifies vendor-specific requirements for supply chain security, covering various aspects including but limited to supply chain program governance, security in manufacturing and operations, logistics, as well as vendor physical and personnel security. These guidelines help us maintain the highest standards in security in service and incident management, and third-party supplier management.

NATO Security Directive

The Directive on Classified Project and Industrial Security is binding and mandatory in nature for NATO Member Nations, commands and agencies. In relation to NCIA business opportunities, Appendices 3 and 4 to the Directive are especially important, as these provide the minimum measures required for the protection of information classified as NATO RESTRICTED.
